Oh My Land Club Play Area Rules
a) No bare feet allowed.
b) Grip socks are required in the play areas at all times, as certain play area floors can be very slippery. Failure to comply with this policy increases the risk of slip-and-fall incidents, and participants who choose to disregard this requirement do so at their own risk.
c) All participants must be accompanied and supervised by a responsible adult at all times.
d) No food, drinks, or gum is allowed in the play area.
e) No roughhousing, pushing, or shoving is allowed in the play area.
f) No climbing on or over the safety netting, barriers, and the outside of play structures.
g) No throwing of any objects within the play area.
h) No outside toys or equipment are allowed in the play area.
i) Any damage to the equipment or property must be reported immediately to a staff member.
j) Oh My Land Club Ltd. reserves the right to deny entry or remove any participant who violates the rules or behaves in an unsafe or disruptive manner.
Oh My Land Club Liability Waiver, Release, and Assumption of Risk.
1. In consideration of Oh My Land Club Ltd., hereinafter called “Oh My Land Club”, allowing any and all children and/or accompanying adults who enter the facility under the direct or indirect supervision of the undersigned Responsible Adult (all of whom are hereinafter collectively referred to as “the Participant(s)”), to use their facilities, I hereby for myself, the Participant, their heirs, executors, administrators, or anyone who might claim on their behalf warrant and agree as follows:
2. I warrant and represent that I am the parent, legal guardian of or have been duly authorized by the parent or legal guardian to represent the Participant(s) named above. By entering Oh My Land Club, I acknowledge and I am fully aware of the inherent risks present in an indoor play environment. That the equipment and the nature of its use can be dangerous and may result in serious injury to myself and the Participant(s). These risks include, without limitation, damage to personal property, personal injury or death. I have read and agree to follow the Oh My Land Club safety rules (“Rules”), which form part of this Waiver. I agree to use the Oh My Land Club facilities only in accordance with the Rules.
3. I understand and agree that Oh My Land Club, its shareholders, officers, directors, employees, management, contractors, agents or other representatives (the “Representatives”) shall not be liable for any injury, damage or loss that I or the Participant(s) may suffer as a result of using the Facility. I understand and agree that Oh My Land Club and its Representatives are not responsible for the supervision of the Participant(s), including the disappearance.
4. I hereby release and forever discharge Oh My Land Club and its Associates from any liability, and any and all loss, damage, injury or expense to person or property that I or the Participant(s) may suffer as a result of the Participant(s) using the premises. I agree to hold harmless and indemnify Oh My Land Club and its Associates from any and all liability for any property damage or personal injury to any third party resulting from the Participant(s) using the premises.
5. If the Participant(s) is a minor, I the undersigned, parent or guardian, hereby give permission for Oh My Land Club to authorize emergency medical treatment as may be deemed necessary for the Participant(s) named above while participating in activities at the Facility. The undersigned hereby releases, discharges, covenant to bring an action and agrees to indemnify and save harmless Oh My Land Club from all liability, claims, demands, losses or damages on the Participant(s) account caused or alleged to have been caused in whole or in part by the negligent medical treatment, failure to provide medical treatment, and further agree to indemnify, save and hold harmless Oh My Land Club and its Representatives from any liability whatsoever as a result of any such claim.
6. I represent and warrant that the Participant(s) is/are in good physical condition and physically able to play in the Facility and that the Participant(s) is/are old enough to participate.
7. I agree and acknowledge that my execution of this Waiver on the initial visit, or for one of the Participant(s), will and does authorize Oh My Land to enter this Waiver into its database and use it as a continuous, multi-use waiver for the Participant(s) ongoing entry to the Facility.
